WASHINGTON, DC – Congresswomen Jackie Speier (D-San Francisco/San Mateo) issued the following statement after her amendment was approved that prohibits funds to implement a provision of Executive Order 13369 from going into effect for the 2015 Department of Defense Appropriations Act, H.R. 4870. The Executive Order would have allowed Military Rule of Evidence 412 to be admissible in Article 32 preliminary proceedings to allow a sexual assault victim’s previous sexual history to be heard.

“The President’s Executive Order usurps and reverses the progress Congress has made in reforming Article 32 proceedings. It explicitly allows survivors to be subjected to indecent and degrading questions even before the court-martial would start,” Congresswoman Speier said. “Shockingly, this Order doubled down on a harmful rule and would have allowed case-destroying evidence to be admissible in preliminary hearings. I am thankful for the bipartisan support needed to prohibit this destructive Order.”
